My Home Base provides home renovation, remodelling, interior design, exterior work, security installation, solar panel installation, flooring, roofing, gutter installation, lawn installation, door installation, fire safety solutions, smart lock and doorbell installation, home décor, and home warranty services. The specific scope of work for each project will be outlined in a separate project agreement or proposal.
2. Project Agreements and Proposals
Before commencing any work, we will provide you with a detailed project proposal or agreement that includes the scope of work, estimated timeline, pricing, payment schedule, materials to be used, and any applicable warranties. By signing the proposal or agreement, you acknowledge and accept the terms specific to your project.
3. Pricing and Payments
- All prices are quoted in USD unless otherwise specified.
- Quotes are valid for 30 days from the date of issuance unless otherwise stated.
- A deposit may be required before work begins, as specified in the project agreement.
- Payment schedules will be outlined in the project agreement and may include milestone payments.
- Additional work or changes to the original scope will be documented and priced separately before execution.
- Late payments may incur a fee of 1.5% per month on the outstanding balance.
- We accept credit cards, bank transfers, checks, and financing options where available.
4. Cancellation and Refund Policy
- You may cancel a project before work begins with a full refund of any deposits paid, minus a $150 administrative fee.
- Once work has commenced, cancellation fees will apply based on the work completed and materials purchased.
- Refund requests must be submitted in writing and will be processed within 30 business days.
- My Home Base reserves the right to terminate a project agreement if the client fails to meet payment obligations or obstructs the work process, in which case the client will be responsible for costs incurred.
5. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your home and project requirements.
- Ensure our team has safe and reasonable access to the work area during agreed-upon hours.
- Remove personal belongings and fragile items from work areas before work begins.
- Obtain any necessary homeowner association approvals or permissions required for the project.
- Make timely payments as outlined in the project agreement.
- Communicate any concerns or change requests promptly through official channels.
6. Warranties
- Workmanship Warranty: We provide a workmanship warranty of 1 year from the date of project completion for most services, covering defects in labor and installation.
- Manufacturer Warranties: Products and materials installed are covered by their respective manufacturer warranties. Warranty details will be provided to you upon project completion.
- Home Warranty Service: Specific terms for home warranty plans are outlined in the separate home warranty agreement.
- Warranties do not cover damage caused by misuse, negligence, natural disasters, unauthorized modifications, or normal wear and tear.
7. Limitation of Liability
To the fullest extent permitted by law, My Home Base shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services. Our total liability for any claim shall not exceed the total amount paid by you for the specific project giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is made.
8. Indemnification
You agree to indemnify, defend, and hold harmless My Home Base, its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, and expenses arising out of or related to your breach of these Terms, your use of our services, or your violation of any law or third-party rights.
9. Insurance
My Home Base maintains comprehensive general liability insurance, workers' compensation insurance, and other applicable insurance coverage. We will provide certificates of insurance upon request. Clients are encouraged to verify that their own homeowner's insurance provides adequate coverage during renovation projects.
10. Permits and Compliance
My Home Base will obtain all necessary permits and ensure compliance with applicable building codes, zoning regulations, and local ordinances. Permit costs are typically included in the project quote unless otherwise stated. If unforeseen code requirements increase project costs, we will communicate this promptly and seek your approval before proceeding.
11. Website Use
When using our website, you agree not to:
- Use the website for any unlawful purpose or in violation of any applicable regulations.
- Attempt to gain unauthorized access to any portion of the website or its systems.
- Interfere with or disrupt the website's functionality or servers.
- Copy, reproduce, distribute, or modify any content from the website without our written permission.
- Upload or transmit any malicious code, viruses, or harmful content.
12. Intellectual Property
All content on the My Home Base website, including but not limited to text, graphics, logos, images, photos, videos, icons, and software, is the property of My Home Base or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. 13. Dispute Resolution
Any disputes arising out of or relating to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation is unsuccessful, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in New York, NY, and the arbitrator's decision shall be final and binding.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in New York County, New York.
15. Modifications to Terms
My Home Base reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website or services after changes are posted constitutes acceptance of the modified Terms. We will make reasonable efforts to notify you of material changes.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
